So sad to be studying International Law these days. The killing of 40+ children (I Imagine girls) by an UStael airstrike to an Elementary Girls School in Minab, could be considered a warcrime? I know nor the U.S. and Israel are part of the Rome Statute but what kind of accountability can we think from I.L towards them (Even though the U.S. and Israel have never paid for their crimes even when prosecuted -i.e. Nicaragua Case was never paid)?
Sad indeed, Juan! Yes war crime if proven that it was intentional. The ICC isn’t an option but there might be others ways to prosecute that we can think of (I list these tentatively without having done the legal research into feasibility yet): US courts (possible violation of US war crimes act), Iranian courts, and courts in some countries that allow prosecution of war crimes regardless of where they occurred (under ‘universal jurisdiction’). Might do a followup post on this, thanks for commenting!
